GenerousWebHosting.com - Also referred to as TOS. By signing up for any service with GenerousWebHosting.com you hereby agree to our TOS and Privacy Policy. Any customer and individual who signs up with GenerousWebHosting.com from now on will be reffered to as Client, User, Customer.

Like all hosts GenerousWebHosting.com is not responsible for the content of it's clients and cannot be held accountable for the contents of a clients website. If an account and or client is found in violation of the TOS, this will result in immediate termination and or suspension. We reserve the right to cancel an account at any time without refund. GenerousWebHosting.com actively monitors the content of client websites to ensure adequate service, and to protect our reputation as a quality web host. We pride our selves on quality, reliable and fast web hosting. The TOS has been created with our core service policies in mind.

Our Policy has been formulated with the following goals in mind:

• Ensure security, reliability and privacy of GenerousWebhosting networks, servers and computers.
• Avoid situations that may cause GenerousWebHosting liable for legal action. - Maintain the image and reputation of GenerousWebHosting as a responsible provider
• Encourage the responsible use of net resources, discouraging practices which degrade the usability of network resources and thus the value of Internet services
• Preserve the privacy and security of individual users and clients.

The Terms Of Service below defines the actions which GenerousWebhosting.com considers to be abusive, and thus, strictly prohibited. The examples named in this list are non-exclusive, and are provided solely for guidance to GenerousWebHosting.com customers. If you are unsure whether any contemplated use or action is permitted, please send mail to policy@generouswebhosting.com and we will assist you. Immediate termination and or suspension of an account with out refund will result if found in violation of our TOS.

Please note that the actions listed below are also not permitted from other Internet Service Providers on behalf of, or to advertise, any service hosted by GenerousWebHosting.com, or connected via our network. Furthermore, such services may not be advertised via deceptive marketing policies, as defined by the Federal Trade Commission Deception Policy Statement.

General Conduct

1. Customers are prohibited from transmitting on or through any of GenerousWebhosting.com services, any material that is, in GenerousWebHosting.com sole discretion, unlawful, threatening, abusive, libelous, or hateful, or that encourages conduct which would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law. If a client is found in violation of international, state or federal law the client will assume full responsibility.

2. GenerousWebHosting.com services may only be used for lawful purposes. Transmission or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. GenerousWebHosting.com reserves the right to remove such illegal material from its servers.

3. The customer is responsible for keeping his billing data with GenerousWebHosting.com up-to-date and accurate. Furnishing false data on the signup form, contract, or online application, including fraudulent use of credit card numbers, is grounds for immediate termination, and may subject the offender to civil or criminal liability. You must pay your bill within 30 days or you account will be terminated.

4. You may not host pornographic, nudity, or sacrilegious websites. No Pornographic, racist or anti-religious websites will be allowed.

5. If a client pays via check, and there are insufficient funds from the payee the client will be held accountable for the bank fee incurred by GenerousWebhosting.com. Failure to pay the fee will result in immediate termination of the account.

6. We reserve the right to not answer and or terminate a support request if found in violation of our TOS. We cannot be held accountable for support answers beyond our realm of services which are limited to web hosting.

7. We reserve the right to determine if your account is hogging or over utilizing server resources. Your account can be suspended and terminated because of resource abuse.

8. You are ultimately responsible for backing-up your own website and files.

System and Network Security

1. Customers may not attempt to circumvent user authentication or security of any host, network, or account (\"cracking\"). This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, or probing the security of other networks (such as running a SATAN scan or similar tool). Customers may not hack or attempt to tamper with any other client of GenerousWebhosting.com or any other network in existence.

2. Customers may not attempt to interfere with service to any user, host, or network (\"denial of service attacks\"). This includes, but is not limited to: \"flooding\" of networks, deliberate attempts to overload a service, and attempts to \"crash\" a host.

3. Users who violate systems or network security may incur criminal or civil liability. GenerousWebHosting.com will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

4. Users may not abuse GenerousWebHosting.com resources by offering file sharing, video downloading, and music downloading. You may not share copyrighted music and or videos with any service provided by GenerousWebHosting.com. The client will be fully liable for any copyright violations.

5. Clients may not abuse server resources and or networks by excessive file uploading and or downloading.

6. All uploads are and can be subject to approval by GenerousWebHosting.com

Email

1. Harassment, whether through language, frequency, or size of messages, is prohibited.

2. Customers may not send email to any person who does not wish to receive it. If a recipient asks to stop receiving email, the customer must not send that person any further email.

3. Customers are explicitly prohibited from sending unsolicited bulk mail messages (\"junk mail\" or \"spam\"). This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. Such material may only be sent to those who have explicitly requested it.

4. Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings.

5. Malicious email, including but not limited to \"mailbombing\" (flooding a user or site with very large or numerous pieces of email), is prohibited.

6. GenerousWebHosting.com accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy.

7. These rules apply to other types of Internet-based distribution mediums as well, such as RLG's Ariel system (a system for sending FAX-like documents over the Internet). USENET postings have their own regulations; see below.

IRC

1. The running of bots off the GenerousWebHosting.com network is not allowed. Bots put strain on the network and the cpu, which degrades the performance of the service.

2. Any Other service found to degrade service performance is strictly prohibited.

Crontabs and Telnet Shells

1. GenerousWebHosting.com shell accounts operate on shared resources. Customers are prohibited from excessive consumption of resources, including CPU time, memory, disk space, and session time. The use of resource-intensive programs which negatively impact other system users or the performance of GenerousWebHosting.com systems or networks is prohibited, and GenerousWebHosting.com staff may take action to limit or terminate such programs.

2. Password security is the responsibility of the individual user.

Service Statues and TOS statues

1. We, GenerousWebhosting.com reserve the right to change this TOS, which upon you agreed to abide by, at any time. We do not have to give you notification for any change in TOS. It is your responsibility to keep up to date with our service policies and regulations.

2. We reserve the right to terminate your account at any time.

Uptime:

We are not responsible for the Uptime of your website, and our servers. We cannot be held accountable for hard drive failure, datacenter downtime, natural disasters, electrical problems, power outages, floods, acts of god, and any other problem that occurs with the preformance of the server.

Privacy Policy

We do not share your personal, or any other data submitted to us by you, the client, with any other third party or company. Your information remains with us and is not shared beyond our staff. Your security, and privacy is of utmost importance to us. Any information requested by you on our sign-up or order forms including, address, credit cards, phone numbers, etc. is shared with no one outside of GenerousWebHosting.com We do NOT see your credit card number and other data beyond information requested in our sign up form.
